Copyright Standards

Fair Use

  • Nature of copyright work (fact vs. fiction).
  • Amount and substantiality of portion used in relation to copyrighted as a whole (10% vs. all) .
  • Effect of use on potential market (would it sell).

    • Permissible

    Single copy of:

  • A chapter book
  • Periodical or newspaper article
  • Short story
  • Chart, graph, diagram, drawing, cartoon or picture (cannot be used to accumulate a compilation or entire book)

    • Classroom use:

  • Multiple copies if:  Poem<250 words, Prose<2500 words or excerpt of 1000 words (must include notice of copyright).


    • Not Permissible

  • Consumables- workbooks, exercises, standardized tests
  • Substitute for purchase of book, publishers reprint or periodical
