Categories of Employment

Non-exempt and Exempt Positions

Positions which do not meet the exemption provisions of the Fair Labor Standards Act (FLSA) are defined as non-exempt positions. Staff members in non-exempt positions report time worked daily or complete time worked reports daily. Staff members in non-exempt positions are eligible for additional pay for time worked beyond regularly-scheduled hours. The FLSA provides that staff members in non-exempt positions are entitled to overtime pay at 1.5 times their regular pay rate for hours worked beyond 40 in a workweek. In limited circumstances compensatory time off may be used in lieu of overtime. The university's overtime policy is more generous than required by the FLSA-the university considers both hours worked and paid leave hours in counting toward the forty (40) hour threshold for overtime eligibility.

Exempt positions are those which meet the exemption provisions of the FLSA. Staff members in exempt positions are not eligible for pay or compensatory time off for additional time worked.

Regular and Temporary Positions

Most positions are considered to be "regular"; that is, they are ongoing positions with no defined ending date and no specified term. Regular positions can end-there is just no current expectation that they will end at a defined time.

"Temporary" positions are short-term assignments to complete special projects, to assist during a peak load period, etc. A temporary assignment is not to exceed six (6) months without prior approval of the responsible vice president in consultation with the Director of Human Resources and Affirmative Action.

A temporary staff member is not eligible for benefits except when stipulated in a written agreement for a long-term temporary assignment which has been authorized by the Director of Human Resources and Affirmative Action. A temporary staff member is eligible for holiday pay in accordance with the "Holidays and Bonus Days" policy in the Benefits and Services section of this manual. Temporary staff members do not have access to corrective action counseling and appeal procedures. A staff member in a temporary position who is subsequently appointed to the same position on a regular basis with no break in service will be granted continuous service credits from the date hired in the temporary position.

Full-time and Part-time Positions

A full-time position is one with a work schedule of forty (40) hours per week, twelve (12) months per year (2,080 scheduled hours of work per year).

A part-time position is one with a work schedule that results in less than 2,080 scheduled work hours per year.

Benefits-eligible Positions

For the purpose of determining work schedule eligibility for disability insurance and education benefits, an eligible staff member is one whose work schedule results in a minimum of 1,560 scheduled hours of work per year (.75 FTE). For the purpose of determining work schedule eligibility for the flexible benefits plan, an eligible staff member is one whose work schedule results in a minimum of 1,040 scheduled hours of work per year (.50 FTE). For the purpose of determining eligibility for retirement plan contributions, an eligible staff member is one who has worked a minimum of 1,000 hours in a year.
